EU Notices for Voluntary/Non-Regulatory FINRA Online Services

FINRA is a U.S. based self-regulatory organization. FINRA does not have offices outside of the United States or direct goods and services to non-U.S. residents. Despite this, interactions between EU residents and the FINRA Online Services may occur. As FINRA is committed to protecting the privacy and security of personal information this supplemental privacy policy (“SPE”) applies to those individuals electing to opt-in to the FIND database.

Participation in the Financial Industry Networking Directory (FIND)TM is purely voluntary and you consent to the following uses of your personal information when you opt-in to the SIE CD and populate the optional data fields.

1. What do we collect?

Participation in FIND is voluntary and FINRA will collect certain personal information on a voluntary basis with the explicit purpose of sharing it with others.

  1. Collected data will include the following (all fields Optional unless otherwise noted): first name (required); middle name; surname (required); email address (Required); link to LinkedIn profile; education level/degree; degree completion status; university attended; major/area of study; areas of interest in the financial services industry; employment status; current/most recent employer; current geographic location; willingness to relocate (with city selections)
  2. Data identified above as required is pulled from the SIE registration form and is data that FINRA will retain in accordance with the Privacy Statement and FINRA’s regulatory requirements.

2. How do we use the personal information?

FINRA’s data collection and use practices pertaining to FIND includes:

  1. Sharing your personal information included in the FIND with potential employers in the financial services industry. We may make access to FIND available to these firms as a paid or free subscription.
  2. Using the information you provide for further product development support.
  3. Using the information in aggregate form for research and publications, including sharing it with academics and academic institutions.

3. What are our lawful grounds for processing personal information?

FINRA may rely on the following lawful grounds when we collect and use your personal information to operate FIND and provide goods and services associated with it:

  1. Consent – We may rely on your freely given consent at the time you provided your personal data to us for inclusion in the FIND service. You may opt out at any time or may access your profile at any time to edit or remove any of the optional data fields.
  2. Legitimate Interests – We may rely on our legitimate interests where the processing is necessary for these interests based on our evaluation that the processing is fair, reasonable and balanced. These interests primarily include meeting our legal obligations and public interests. We may process your personal information in order to meet regulatory, legal and public interest obligations or requirements.

4. What are the relevant data protection rights of EU data subjects?

EU data subjects have certain rights with respect to the processing of their data. The list below outlines those rights as they apply to the intended use of the data in the FIND service. This list is not inclusive and the truncated nature of the list does not affect the rights of data subjects under EU law.

  1. Access – You can ask us to verify whether we are processing personal data about you, and if so, to provide more specific information about the data concerned.
  2. Rectification – You can ask to correct our records if you believe they contain incorrect or incomplete information about you.
  3. Erasure – You can opt-out and ask us to erase (delete) your personal information after you withdraw your consent to processing or when we no longer need it for the purpose it was originally collected. You may enact your opt-out preferences within the FIND service itself. If you have any questions or concerns about this opt-out process, please contact us.
  4. Right to Withdraw Consent – You can withdraw your consent that you have previously given to one or more specified purposes to process your personal data. Your withdrawal of consent may impact our ability to provide certain products or services to you and we will advise you if this is the case.
  5. Right to lodge a complaint with a supervisory authority - If you have any complaints about the processing of your personal information, please contact us. You also have the right to lodge a complaint with a supervisory authority.

We may need to request specific additional information from you to help us confirm your identify and ensure appropriate access to the data. This helps us protect your data from inadvertent disclosure to unauthorized persons. We will collect and treat any supplementary personal information in accordance with the terms of our Privacy Statement.
